Q: How to apply for a working visa?
A: There are a few types of working visa. The most and frequently applied is H1b Visa.
H1b visa is a non-immigrant visa to work for a maximum of 6 years.H-1B status requires a sponsoring U.S. employer. The employer must file a labor condition application ("LCA") with the Department of Labor attesting to several items, including payment of prevailing wages for the position, and the working conditions offered. The employer must then file an I-129 petition with the Bureau of Citizenship and Immigration Services (previously INS) and, unless specifically exempt under the law, an additional $500 fee to sponsor the H-1B worker. Based on the Bureau petition approval, the alien may apply for the H-1B visa, admission or a change of nonimmigrant status.
Q: For Visitor Visas, do applicants need to document that they have sufficient funds to pay for the stay?
A: Yes. Those applicants who don't have sufficient funds to support themselves while in the U.S. must present convincing evidence that an interested person will provide support. Visitors aren't permitted to accept employment during their stay in the U.S. Depending on individual circumstances, applicants may provide other evidence substantiating the trip's purpose and specifying the nature of binding obligations, such as family ties or employment, which would compel their return abroad.
Q: What documents are generally required for a fiancée visa?
A: The consular officer will notify the beneficiary when the approved petition is received and provide the beneficiary with the necessary forms and instructions to apply for a "K" visa. A fiancé(e) visa applicant is an intending immigrant and, therefore, must meet documentary requirements similar to the requirements of an immigrant visa applicant. The following documents are normally required:
- Valid passport
- Birth certificate
- Divorce or death certificate of any previous spouse
- Police certificate from all places lived since age 16
- Medical examination
- Evidence of support
- Evidence of a valid relationship with the petitioner
- Photographs (according to specifications)
